Resolution concerning the Department of Education (2011)


WHEREAS, the United States Department of Education is currently a Cabinet level department of the United States Government; and

WHEREAS, the powers of the United States Congress are enumerated in Article I, Section 8 of the U.S. Constitution; and

WHEREAS, education of the American people is not listed as a power nor a responsibility of the Federal Government; and

WHEREAS, the Tenth Amendment to the U.S. Constitution states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”; now therefore be it

RESOLVED by the Georgia Republican Party that we, as a people and as a state, demand the elimination of the U.S. Department of Education, and that the responsibility for education be returned to the several States and citizens as required by the Tenth Amendment to the U.S. Constitution.
